These Terms of Service ("Terms") apply to your use of Mapakin ("Service"). By accessing or using Mapakin, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use Mapakin.

1. Use License

We grant you a limited, non-exclusive, non-transferable license to access and use Mapakin for your personal and non-commercial purposes. You agree not to:

• Reproduce, duplicate, copy, sell or resell Mapakin or any part of it.
• Access the Service in order to build a similar or competitive service.
• Use the Service to harm, threaten, abuse or harass others.
• Upload, post or transmit content that violates laws or others' rights (including copyright, privacy and intellectual property).
• Use automated means (bots, scrapers) to access or download content without permission.
• Interfere with or disrupt the Service's functionality or servers.

2. Your Account

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. If you believe your account has been compromised, notify us immediately at contact@mapakin.com.

3. Content Ownership

You retain full ownership of any maps, blocks, notes, images, PDFs and files you create or upload to Mapakin. By uploading content, you grant us the right to store, display and process it solely to provide the Service to you.

4. Acceptable Use

You agree to use Mapakin only in compliance with all applicable laws and these Terms. You agree not to upload, share or transmit content that is:

• Illegal, fraudulent or harmful.
• Sexually explicit, obscene or defamatory.
• Infringing on intellectual property rights.
• Containing malware, viruses or malicious code.

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MAPAKIN IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF MAPAKIN.

6. Indemnification

You agree to indemnify and hold harmless Mapakin, its owners, operators and employees from any claims, damages or costs (including attorney's fees) arising from your violation of these Terms or your use of the Service.

7. Termination

We may terminate your access to Mapakin at any time, with or without notice, if you violate these Terms or engage in behavior we deem harmful to the Service. Upon termination, your right to use Mapakin immediately ceases.

8. Service Availability

Mapakin is provided on an "as-is" basis. We do not guarantee uninterrupted, error-free or secure service. We may modify, suspend or discontinue Mapakin at any time with or without notice.

9. Disputes and Governing Law

These Terms are governed by and construed in accordance with the laws of France, and you irrevocably submit to the exclusive jurisdiction of the courts located in France.

10. Changes to Terms

We may update these Terms at any time. Your continued use of Mapakin after changes constitutes your acceptance of the new Terms. The date above shows the latest revision.
